Terms of Service

1. Acceptance of Terms

By accessing or using the Service, you represent and warrant that (a) you have the legal capacity to enter into a binding agreement, (b) you are at least 13 years of age (or the applicable minimum age in your jurisdiction), and (c) your use of the Service complies with all applicable laws and regulations.

2. Description of the Service

Watchy is a free-to-use service that provides movie information, search functionality, personalized watchlists, streaming availability, and related entertainment features. Movie data is sourced from The Movie Database (TMDB). Streaming, rental, and purchase availability data is sourced from JustWatch and is delivered to the Service through TMDB's watch providers endpoint; where this data is displayed, the Service shows the attribution "Powered by JustWatch." The Service is provided free of charge; the App may display advertisements. The Web Platform is provided ad-free.

3. License

Subject to your compliance with these Terms, Watchy grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App on devices you own or control, and to access the Web Platform, solely for your personal, non-commercial use.

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code or underlying ideas of the Service.
• Modify, adapt, translate, or create derivative works of the Service.
• Remove, alter, or obscure any proprietary notices, trademarks, or copyright notices on or in the Service.
• Use any automated means, including bots, scrapers, or data-mining tools, to access, collect, or extract data from the Service.
• Interfere with, disrupt, or impose an unreasonable load on the Service or its infrastructure.
• Attempt to gain unauthorized access to any portion of the Service, other users' data, or any related systems or networks.
• Use the Service to transmit any virus, worm, malicious code, or other harmful material.
• Circumvent or attempt to circumvent any technical measures used to protect the Service or its content.

5. Support and Tips

The Service may provide the option to support development through voluntary tips processed by Buy Me a Coffee. Tips are entirely voluntary, are not required to access or use the Service, and are non-refundable except as required by applicable law. By leaving a tip, you acknowledge that you are providing financial support and are not purchasing any product, service, feature, or entitlement. All tip transactions are governed by Buy Me a Coffee's terms of service and privacy policy.

6. Third-Party Services and Data

The Service integrates with and relies upon the following third-party services. Each is governed by its own terms of service, and your use of the Service constitutes your acceptance of those terms where applicable:

TMDB.

Movie data, images, and metadata are provided by The Movie Database, operated by TiVo Platform Technologies LLC. As required by TMDB's API Terms of Use: "This product uses TMDB and the TMDB APIs but is not endorsed, certified, or otherwise approved by TMDB."

JustWatch (via TMDB).

Streaming, rental, and purchase availability data is sourced from JustWatch and delivered to the Service through TMDB's watch providers endpoint. The Service does not call the JustWatch API directly. The Service displays the "Powered by JustWatch" attribution wherever this data is shown, as required by TMDB's API terms.

Google Firebase.

Analytics, crash reporting, performance monitoring, and (on the Web Platform) waitlist storage are provided by Google Firebase.

Google AdMob.

Advertisements in the App are served by Google AdMob. The Web Platform does not serve advertisements.

Buy Me a Coffee.

Voluntary tips are processed by Buy Me a Coffee.

We are not responsible for the accuracy, availability, content, or practices of any third-party service. Your use of any third-party service is at your own risk and is subject to that service's terms and policies.

7. Intellectual Property

All intellectual property rights in and to the Service, including but not limited to the App's source code, design, user interface, graphics, logos, and trademarks (excluding third-party content sourced from TMDB, JustWatch, and others), are owned by or licensed to Rabindranath Ferreira. Movie posters, images, titles, descriptions, cast information, and related metadata displayed in the Service are the property of their respective owners and are used in accordance with the terms of the applicable third-party services.

8. User Content

Any content you create within the Service, including your personal library, watchlist, preferences, and settings, is stored locally on your device and is not transmitted to or stored by Watchy. You retain all rights to such content. Information you voluntarily submit to the Web Platform (such as the name and email address used to join the iOS launch waitlist) is handled in accordance with the Privacy Policy.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WATCHY EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Watchy makes no warranty that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components, or that any defects will be corrected. Watchy does not warrant the accuracy, completeness, reliability, or timeliness of any information displayed in the Service, including data provided by TMDB, JustWatch, or any other third-party source.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RABINDRANATH FERREIRA BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WATCHY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE EXTENT LIABILITY CANNOT BE EXCLUDED, THE TOTAL AGGREGATE LIABILITY OF WATCHY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED TEN UNITED STATES DOLLARS (USD $10.00). YOU ACKNOWLEDGE THAT THE SERVICE IS PROVIDED FREE OF CHARGE AND THAT THIS LIMITATION REFLECTS A REASONABLE ALLOCATION OF RISK.

11. Indemnification

You agree to indemnify, defend, and hold harmless Rabindranath Ferreira from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) your infringement of any third-party right.

12. Modifications to the Service

Watchy reserves the right, at any time and without prior notice, to modify, suspend, or discontinue the Service (in whole or in part), and to add, remove, or change any features, functionality, or content. Watchy shall not be liable to you or to any third party for any such modification, suspension, or discontinuation.

13. Modifications to These Terms

Watchy reserves the right to modify these Terms at any time. When changes are made, the "Effective Date" at the top of these Terms will be updated. Your continued use of the Service following any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.

14. Termination

Watchy may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including without limitation if you violate these Terms. You may terminate your use of the Service at any time by uninstalling the App and discontinuing use of the Web Platform. Upon termination, all licenses granted to you under these Terms will immediately cease.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws applicable in your country of residence, without regard to its conflict-of-laws principles. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through the competent courts of your jurisdiction, except where mandatory consumer-protection laws of your jurisdiction provide otherwise.

Nothing in these Terms restricts any non-waivable rights or remedies available to you under the mandatory consumer-protection laws of your jurisdiction.

16. Severability and Entire Agreement

If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable, or, if such modification is not possible, shall be severed from these Terms. The invalidity of any provision shall not affect the validity of the remaining provisions.

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Rabindranath Ferreira regarding the Service and supersede all prior or contemporaneous agreements, representations, or understandings.
